1. Acceptance of Terms

By downloading, accessing, or using EquiEarn (the "App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

2. Mandatory Safety & Risk Acknowledgment

• Horses are unpredictable animals that may kick, bite, trip, or bolt without warning.
• The terrain and environment where riding occurs may contain hidden hazards.
• Assumption of Risk: You voluntarily assume all risks associated with equine activities, including the risk of serious bodily injury, permanent disability, and death.
• Distraction Warning: You agree not to use the App in a manner that distracts you while mounted or handling a horse.

3. Limitation of Liability & Waiver

To the maximum extent permitted by law, LoolaApps, its owners, officers, and employees (the "Company") shall not be liable for any personal injury, death, accidents involving horses, or damage to property occurring during the use of the App.

Waiver: By using this App, you hereby waive, release, and discharge the Company and its owners from any and all claims of liability, including claims of negligence, arising out of or related to your use of the App or participation in horse-related activities.

4. Data Submission & Ownership

By submitting a ride recording ("Ride Data") through the App, you agree to the following:

• Release of Rights: You irrevocably release all rights, titles, and interests in and to the Ride Data to LoolaApps.
• Usage & Sale: You acknowledge and agree that the Ride Data may be stored, analyzed, used for machine learning/AI training, and sold to third parties by EquiEarn and LoolaApps.
• Anonymization: The Company agrees that no personally identifiable information (PII) is stored with the Ride Data. The data consists strictly of anonymized sensor metrics (e.g., motion, gait, and speed data).
• No Reversion: Once Ride Data is submitted, the release of rights is permanent and cannot be revoked.

5. User Responsibilities

• Accuracy: You agree to label gaits (walk, trot, canter) accurately to the best of your ability.
• Safety Gear: We strongly recommend the use of ASTM/SEI-certified helmets and appropriate safety gear at all times.

6. App Store Provisions (Apple/iOS)

You acknowledge that these Terms are between you and LoolaApps only, and not with Apple Inc. Apple has no obligation to furnish maintenance or support services for the App.

7. Governing Law

These terms shall be governed by the laws of the United States, without regard to its conflict of law provisions.
